Registration terms and conditions:

These terms and conditions set out on what basis we agree to your registration to support our charity in the Breast Walk Ever 2019 (the “Activity”).

These terms and conditions will apply in addition to any contract between us for your taking part in the Activity (a “Contract”). Please ensure you read these terms and conditions carefully and make sure that you understand them before proceeding with your commitment. Please note that before proceeding you will be asked to agree to these terms and conditions.

Please tick the waiver box on the registration form if you accept them. If you refuse to accept these terms and conditions, you will not be able to proceed to register your support for the Activity.

You should print a copy of these terms and conditions or save them to your computer for future reference.

We amend these terms and conditions from time to time as set out in paragraph 6 below. Every time you wish to register with us, please check these terms and conditions as the terms and conditions displayed as at the time of your order will apply to that order. These terms and conditions were most recently updated on 11th January 2019.

These terms and conditions and any Contract between us will only be in the English language and under English Law.

  1. Personal Information

We use your personal information in accordance with our Privacy Policy which you can request to view by emailing info@againstbreastcancer.org.uk

  1. Photo & Recording consent

Photos and recordings, both words and film, of supporters are very important to us. We use them to tell people about the work we do and how they can help.

The photos and/or recordings of you will show that you support our work in the UK. We may use your pictures, video and story in our communications materials in the future. We may also share your materials with our trusted partners, and your story may appear in their communication materials.

We will keep your information in a safe place to protect you.

By agreeing to these terms and conditions and completing this registration:

  • You agree that we may record free of charge your contributions on sound recordings, film, photographs and any other electronic recordings, and may use your contributions in any media (whether already known, or developed in the future) throughout the world and without any payments.
  • We may edit, adapt or translate your contribution, and you confirm that you waive all ‘moral rights’ to enable the uses set out above.
  • We may use your contributions from time to time at any point in the future. We very much hope to use your contribution, but we cannot guarantee to do so.
  • We may also share your materials with our trusted partners, and your story may appear in their communications and is subject to consent you have given in these terms.
  • In the event that a photo and/or recording of a child aged under 18 is used, prior permission will be sought from the parent/legal guardian.
  1. Your Charity Entry Communications and Termination

Notwithstanding your marketing preferences, you will be contacted by us about the Activity to help you fundraise and to keep you up-to-date on the Activity. This will ensure that you are able to undertake the Activity and to help you raise funds in support of us.

If you wish to end your support to us then please contact us on events@againstbreastcancer.org.uk.

All refunds of donations paid to us shall be at our sole discretion. If you terminate your support to us in respect of this Activity then immediately you must pay us all donations or return the funds to your sponsors.

  1. Against Breast Cancer’s obligations

We will give you fundraising tips and to keep you up-to-date on the Activity in accordance with 3 above.

  1. Limitation on Liability

Anyone aged under 18 MUST be accompanied by an adult aged 18 or over.

You confirm that you will be 18 years of age or over when the Activity takes place and you are in a fit condition to participate with no medical conditions that may affect you. You confirm you will not participate in the Activity if you are injured, not in good health, or not fit enough to undertake the Activity. You should familiarize yourself with the safety briefing given by the Activity organisers.

Except for liability for death or personal injury and fraudulent misrepresentation, ABC shall in no event be liable for: (a) incidental; (b) consequential; (c) special or indirect damages whatsoever; (d) damages for loss of business; (e) loss of profits; (f) business interruption; (g) loss of business information or data

Without prejudice to your obligation to pay a fee hereunder, the parties’ maximum liability (but excluding liability for death or personal injury, fraudulent misrepresentation) under this Agreement is limited in respect of each event or series of connected events in any twelve month period as follows:

£100,000 in respect of physical damage to or loss of tangible property;

£10,000 in respect of all other events.

The parties’ sole obligations and liabilities are as stated in this Agreement and all other representations (innocent or negligent), conditions, warranties and terms express or implied whether by statute, law or otherwise including those made prior to the date of your acceptance to these terms are hereby excluded to the full extent permitted by law.

  1. Event Terms and Conditions

You warrant that you have: a) read, understood and accepted the event organisers terms and conditions; and b) met the Activity’s qualifying criteria as set by the event organiser.

We are unable to offer refunds, should you no longer be able to attend. You should refer to the event organiser’s terms and conditions.

You must follow any guidelines and instructions of the event organisers in participating in the Activity. If you are unsure of your physical ability to take part in this Activity then you should take medical advice from a general practitioner prior to the Activity.

On the day of the events, participants who arrive at the 10k start checkpoint after 4.45pm will continue at their own risk and will not be covered by the event’s liability.

  1. Jurisdiction and applicable law

These terms and conditions of supply shall be governed by the laws of England and Wales and shall be subject to the exclusive jurisdiction of the courts of England and Wales.
